2. Interpretation and Definitions
2.1 Interpretation

- Unless otherwise specified, the same meanings apply regardless of whether the words appear in singular or plural.
- Terms not defined here will carry the meaning provided in the Bizzmakr Terms and Conditions of Use.

- Personal Data: Any information relating to an identified or identifiable individual, including but not limited to name, email address, phone number, payment details, transaction history, and identity verification documents.
- Usage Data: Information automatically collected when using the Platform, such as device identifiers, IP address, browser type, log data, and activity history.
- Transaction Data: Information about payments, wallet balances, withdrawals, refunds, and other financial activities performed through the Platform.
- Third-Party Services: External platforms or service providers used by Bizzmakr for login authentication, data hosting, analytics, marketing, or payment processing.
- Service Provider: Any natural or legal person engaged by Bizzmakr to process data on its behalf, including hosting providers, payment gateways, and compliance partners.
- Country: Refers to the People's Republic of Bangladesh, the jurisdiction governing this Policy.

- National Identification Number (NID) or other government-issued ID for verification
- Profile details (skills, expertise, portfolio, uploaded files, images, or videos)
- Optional links added to your profile (e.g., personal website, LinkedIn URL)
3.2 Usage Data
Information collected automatically when you interact with the Platform:
- IP address, browser type, operating system, and device details
- Session history, activity logs, and time spent on pages
- Pages visited, searches, and actions taken on the Platform
- Cookies, pixel tags, and similar technologies (see Section 12: Cookies Policy)
3.3 Transaction Data
Information related to payments and financial activity on the Platform:
- Payment method and details (bank transfers, mobile wallets, cards)
- Transaction history (including commissions, service fees, and withdrawals)
- Refund activity and wallet balances for both Freelancers and Seeking Freelancers
3.4 Data from Device Permissions
With your consent, we may collect:
- Location data (to prevent fraud, assist in compliance checks, and improve services)
- Camera and photo library access (for profile images, document uploads, or project files)
3.5 Communications and Content Data
We may collect and store:
- Messages, proposals, and project files exchanged between Freelancers and Seeking Freelancers
- Dispute resolution submissions and communications with Bizzmakr Support
- Feedback, ratings, and reviews you submit about other users or services
4. Our Legal Basis for Using Your Personal Information
We only process your personal information where we have a lawful basis to do so under the Data Protection Bill 2023 and other applicable laws. This means that your information is processed on one or more of the following grounds:
- Consent: You have given clear and explicit consent for us to process your information for a specific purpose (e.g., receiving marketing communications, storing optional profile links).
- Contractual Necessity: Processing is necessary to perform the contract between you and Bizzmakr, or to take steps at your request before entering into such a contract (e.g., creating an account, completing transactions, managing escrow and wallet balances).
- Legal Obligation: Processing is necessary to comply with our legal or regulatory obligations (e.g., fraud prevention, tax reporting, anti-money laundering requirements, government compliance checks).
- Legitimate Interests: Processing is necessary for our legitimate business purposes (e.g., improving platform functionality, maintaining security, preventing abuse), provided such interests are not overridden by your fundamental rights and freedoms.
4.1 Your Rights
Under the Data Protection Bill 2023, you have the following rights regarding your personal information:
- Right to Access: Request a copy of the personal data we hold about you.
- Right to Correction: Ask us to correct inaccuracies in your data.
- Right to Erasure: Request deletion of your personal data, subject to legal or regulatory retention requirements.

5. How We Use the Information Collected
We use your personal information only for legitimate business purposes, in compliance with the Data Protection Bill 2023 and the Cyber Security Act 2023 of Bangladesh.
5.1 Primary Purposes
Your information may be used for the following purposes:
- To provide services: Enabling account creation, project posting, freelancer-client communication, and secure transactions through the Wallet and Escrow system.
- To process financial transactions: Handling payments, withdrawals, refunds, commissions, and resolving refund-related disputes.
- To verify and secure: Confirming user identity, preventing fraud, monitoring activity, and maintaining a safe and trusted marketplace.
- To comply with laws: Meeting tax, anti-money laundering (AML), and regulatory requirements, and cooperating with lawful requests from authorities.
- To improve the platform: Analyzing user activity, monitoring trends, troubleshooting, and enhancing features and user experience.
- To contact you: Sending service updates, system alerts, notifications, customer support responses, and important account-related information.
- To personalize experience: Tailoring recommendations, search results, and platform features to improve usability.
5.2 Marketing and Promotions
- We may use your information to share updates about new features, promotions, or offers from Bizzmakr.
- Marketing communications will only be sent with your consent or where otherwise permitted by law.
- You can opt out of receiving promotional messages at any time by contacting support@bizzmakr.com or following the unsubscribe link provided in emails.
- Even if you opt out, we may still send you non-promotional messages, such as service-related notifications or important account alerts.

6. How Long Do We Keep Personal Information

- Service Provision: We retain your information while your account remains active, and as long as it is needed to provide you with access to the Bizzmakr Platform and its features.
- Legal and Compliance: Certain records (such as financial transactions, wallet balances, refunds, and tax-related data) must be retained for periods required under Bangladeshi law, including compliance with the Data Protection Bill 2023, tax regulations, and anti-money laundering requirements.
- Closed Accounts: If you close your account, or if it is deactivated by Bizzmakr, we may still retain certain information as long as necessary to:
- Usage Data: Non-identifiable or aggregated usage data may be retained for a shorter period for analysis, security, and platform improvement purposes.
7. Children
Bizzmakr is intended for users 18 years and older.
- Under 13: Users below the age of 13 are not permitted to create an account or use the Platform. If we discover that a user under 13 has created an account, we will terminate the account and permanently delete the associated personal information.
- Ages 13–17: Users between 13 and 17 may only use the Platform with the verified consent of a parent or legal guardian. If parental consent cannot be verified, the account will be terminated and the associated data removed.
- Assumption of Age: By creating an account, users confirm and represent that they are at least 18 years old, or that they are between 13 and 17 years old and have obtained parental or guardian consent.
- We will assume that anyone who has created an account without parental consent is 18 years of age or older.
- We will assume that anyone who has created an account with parental consent is between 13 and 17 years old.
- Parental Notification: Parents or guardians who believe their child has provided personal data to Bizzmakr may contact us at support@bizzmakr.com. We will promptly review the matter and take appropriate action.
8. Sharing Personal Information with Third Parties
We do not sell or rent your personal data. We only share your information under strict conditions, and only to the extent necessary to provide our services, comply with the law, or protect our users.
8.1 Service Providers
We may share personal information with trusted third parties that help us operate the Platform, including:
- Payment processors and banks for payments, withdrawals, and refunds
- Mobile wallet providers (e.g., bKash, Nagad, Rocket)
- Cloud hosting and data storage providers

10.2 Invitations
- Bizzmakr may send invitations to participate in platform events, feature launches, or promotions.

10.3 Send to a Friend (Referral System)
- Users may be given the option to share a referral link, page, or invitation with another person.
- To do so, we may request your email address and the recipient's email address.
- Your email address will be used only to identify you as the sender and to handle transmission errors.
- The recipient's information will be used solely to deliver the referral invitation and will not be stored or reused for other purposes without consent.

- Role-Based Access Controls ensuring that only authorized personnel can access sensitive information.

- Fraud Detection Systems to prevent unauthorized transactions.
15.2 User Responsibilities
While Bizzmakr takes steps to safeguard your information, you also play a role in maintaining security:
- Keep your login credentials and passwords private.
- Use a strong, unique password for your account.
- Log out after accessing your account from shared devices.
15.3 Limitations
Despite strict measures, no method of internet transmission or electronic storage is 100% secure. Bizzmakr cannot guarantee absolute protection against cyberattacks, unauthorized access, or breaches beyond our reasonable control.
By using the Platform, you acknowledge and accept these risks.
16. Deleting or Updating Personal Information
Bizzmakr provides you with the ability to update or delete your personal information in line with the Data Protection Bill 2023.
16.1 Updating Information
- You can review and update your personal information at any time through your account profile settings.
- It is your responsibility to ensure that your account details remain accurate and up to date.

- Once we receive your request, we will remove your personal data from active use, subject to any data retention obligations under Bangladeshi law.

- Certain information may still be retained as necessary to comply with legal requirements, prevent fraud, resolve disputes, or enforce our Terms and Conditions of Use.
- Content shared with other users (such as proposals, messages, or project files) may remain visible to them even after account deletion.
- Copies of User Generated Content (UGC) may remain in cached or archived pages, or may have been saved by other users.
16.3 No Verification Required
Bizzmakr does not require additional identity verification to act on requests to update or delete your personal information.
17. Your Name, Use of Information, and Account Protection
17.1 Your Name
- When registering on Bizzmakr, you must provide your full name.
- Your activities on the Platform (such as proposals, project postings, transactions, or cancellations) may be associated with your name and visible to other users you interact with.
- If you choose to use your real name, other users may be able to personally identify your activities on the Platform.
17.2 Use of Information from Bizzmakr
- The Platform facilitates the sharing of limited personal information between users for the purpose of negotiating, delivering, or receiving services.
